15. Prices.-lt is understood that the prices stated by the Contractor in his tender shall
be taken as those upon which alone he agrees to be paid for work embraced in this specification
and accompanying plans, measurements being made as indicated in paragraph 11. These prices
shall be held as rigidly inclusive, and to cover all failures, accidents, contingencies, plant, labor,
materials, staging, customs, duties, transportation, patent rights, necessary buildings, medical
attendance, etc., and the entire completion of the masonry, and also all damage that may happen
or occur to the works, or any part or portion of them, or to the men, plant and tools provided
and employed, during transit or otherwise, either from galcs, storms, ice, floods, fire or any other
cause whatever, up to their completion to the satisfaction of the Chief Engineer and their delivery
to and acceptance by the Minister, so that the said sums paid as per paragraphs 11 and 12 shall
be the only sums the Contractor shall receive for the works herein called for.
16. Contractor Not Present.-“'hcnever the Contractor is not present on any part of
the ivork where it may be necessary to give directions, orders will be given by the Engineer, and
shall be received and obeyed by the Superintendent or Overseer of the Contractor, who may
have charge of the particular work in relation to which the orders are given, and such orders
shall be C()l'1Sl(lt‘l'l'(l as given to the Contractor.
17. 0missions.!The plans or drawings referred to in this specification aml from which
the work is to be built represent generally the nature and extent of the works to be done and exe-
cuted, and ftirtlier plans of details, or in explanation of the original plans, or of work or works
which have been omitted and are requirul, which shall or may be furnished during the progress
of the work, shall be considered as covered by this specification, and their omissions therefrom
and supply at any future date shall not, in any way, vitiate, invalidate or render nugatory, in
part or in whole, this specification or the contract which will be entered into for the execution
of the works. referred to herein; and it is expressly to be understood that the provisos and stipu-
lations they contain shall remain and apply to all omitted work which may be required and to
detailed plans that may be furnished at any time during the progress of the works.
18. Plans.e.-Xll final plansnitist bear the signature of the Chief Engineer. Dimensions,
where definitely determined, will be iiiiirketl on all plans so furnished. ln no case must dimen-
sions be sealed.
[9, Time of Completion.-The Contractor shall start the work on the North main pier
eight days after the contract is signed and shall diligently prosecute the work so as to have the
North main pier entirely completed by November 1st, 1910.
All other works shall be finished by November 1st, 1911.
As tinte is the essence of this contract and as the date of completion of the whole bridge
will be determined by the date of coiiiplction of each and every one of its component parts, a
sum of One Hundred Thousand Dollars ($100,000) taken out of the One Hundred and Twenty
Thousand Dollars deposited as per paragraph 14, and out of any monies due or to become due
to the Contractor, shall become the property of the Minister as liquidated damage for the non‘
completion of the different parts of the works at the dates fixed (1st November, 1910,and 1st
November, 1911).
In case it hecoines apparent that the work is not proceeding with suliicient speed, in order
to guarantee its completion at the dates specified, the Chief Engineer shall have the right to order
the Contractor to employ more men and apparatus and to have the work prosecuted by night
as well as by day, and the Contractor shall immediately comply with such orders.
20. Right of Way for Contractor of Steel Work:J1‘he Contractor shall so arrange
his work that the Contractor for steel work may be allowed sufficient working room to erect the
falsework for the superstructure and to store and handle such materials as he may require for
this work.
21. Hospital and Medical Attendance.-The Contractor shall build and maintain a
hospital, with proper medical, nursing and other attendance, and all remedies and surgical appli-
ances as may be required, in which all sick or disabled employees shall receive the necessary care.
22. Assignment.-This Contract shall not be assigned, nor shall the said work or any
part thereof be sub-contracted.
